Federal law gives consumers the right to limit some but not all sharing. Federal law also requires us to tell you how we collect, share, and protect your personal information. Please read this notice carefully to understand what we do.

Marketing and lead generation companies choose how they share your personal information. Federal law gives consumers the right to limit some but not all sharing.

What?

The types of personal information we collect and share depend on the product or service you have with us. Since we operate strictly as a debt relief matching service, this information can include:

  • Estimated debt amount and primary type of debt
  • Financial hardship status and state of residence
  • Email address, phone number, and basic contact details

How?

All companies need to share customers’ personal information to run their everyday business. The table below lists the reasons companies can share customers’ personal information, the reasons Liberuna chooses to share, and whether you can limit this sharing.

Please note: If you are a new customer, we can begin sharing your information 30 days from the date we sent this notice. When you are no longer our customer, we continue to share your information as described in this notice. However, you can contact us at any time to limit our sharing.

How does Liberuna protect my personal information?

To protect your personal information from unauthorized access and use, we use security measures that comply with federal law. These measures include computer safeguards and secured files and buildings.

How does Liberuna collect my personal information?

We collect your personal information, for example, when you create a Liberuna account or use our matching Service, communicate with us, or submit a debt relief assessment form.

Why can’t I limit all sharing?

Federal law gives you the right to limit only:

  • sharing for affiliates’ everyday business purposes—information about your eligibility or creditworthiness;
  • affiliates from using your information to market to you;
  • sharing for nonaffiliates to market to you.

State laws and individual companies may give you additional rights to limit sharing.

What happens when I limit sharing for an account I hold jointly with someone else?

Your choices will apply to you alone unless you tell us otherwise.

Definitions

Affiliates

Companies related by common ownership or control. They can be financial and nonfinancial companies.

Our affiliates include KOVA DYNAMICS, S.L.

Nonaffiliates

Companies not related by common ownership or control. They can be financial and nonfinancial companies.

Our nonaffiliates may include debt relief agencies, debt settlement companies, and service providers, such as identity verification services and advertising networks. We explicitly prohibit sharing your information with lenders for the purpose of debt consolidation loans.

Joint marketing

A formal agreement between nonaffiliated companies that together market products or services to you.

Our joint marketing partners may include debt relief network partners, marketing agencies, and other service providers.

Other important information

CA and VT: We will not share information we collect about California or Vermont residents with nonaffiliates, unless the law allows. For example, we may share information with your consent, to facilitate your debt relief matching process, for joint marketing with other institutions, or to provide rewards or benefits you are entitled to. California residents can email info@digitaldatacontrol.com to opt out of our sharing of their information for joint marketing.

Finalités du traitement

Les données personnelles communiquées via les formulaires ou le parcours de préqualification peuvent être traitées afin de :

  • gérer et analyser la demande transmise par l’utilisateur ;
  • effectuer une première préqualification ou orientation à partir des informations déclarées ;
  • mettre l’utilisateur en relation avec des partenaires externes susceptibles de proposer des solutions correspondant à son profil ;
  • traiter les demandes d’information ou de support envoyées via le formulaire de contact ;
  • envoyer des communications commerciales ou informatives lorsque le consentement requis a été obtenu ;
  • respecter les obligations légales, réglementaires, de sécurité et de preuve applicables.

Durée de conservation

Les données sont conservées pendant la durée nécessaire au traitement de la demande et, lorsqu’une relation active existe, pendant la durée utile à sa gestion.

Certaines données peuvent être conservées plus longtemps lorsque la loi, la défense de droits ou des obligations de preuve l’exigent. Les données liées à une relation client ou à la gestion d’une demande peuvent, lorsque cela est applicable, être conservées jusqu’à 5 ans.

Bases juridiques

  • Consentement : lorsqu’il est demandé pour la transmission d’un formulaire, certaines communications ou des traitements optionnels.
  • Mesures précontractuelles : lorsque le traitement est nécessaire pour répondre à une demande initiée par l’utilisateur avant une éventuelle souscription auprès d’un tiers.
  • Intérêt légitime : notamment pour la sécurité du site, la prévention des abus, l’amélioration du fonctionnement et certaines communications compatibles avec la relation existante, sous réserve des droits de l’utilisateur.
  • Obligation légale : lorsque la conservation ou la communication de certaines données est imposée par la réglementation.

Origine et catégories de données

Les données proviennent principalement des informations que l’utilisateur transmet directement à Liberuna.

Selon le formulaire utilisé, elles peuvent comprendre : données d’identification, coordonnées, informations financières déclarées, informations relatives aux crédits et mensualités, préférences, contenu des demandes et données techniques nécessaires à la sécurité ou au fonctionnement du site.

Communication à des partenaires externes

Lorsque cela est nécessaire pour traiter la demande, certaines données peuvent être transmises à des partenaires externes susceptibles d’étudier le profil et de proposer leurs propres produits ou services.

Une fois les données transmises dans ce cadre, l’entité externe peut agir comme responsable de traitement indépendant pour ses propres opérations. Ses conditions et sa politique de confidentialité s’appliquent alors aux traitements qu’elle réalise.

Transferts internationaux

Aucun transfert international spécifique n’est annoncé dans la présente version du site. Si un prestataire ou partenaire impliquait ultérieurement un transfert de données hors de l’Espace économique européen, celui-ci devrait être encadré conformément au RGPD et la présente politique devrait être mise à jour si nécessaire.

Communications commerciales

Lorsque des communications commerciales nécessitent un consentement, elles ne doivent être envoyées qu’après obtention de ce consentement. Aufbewahrungsdauer

Rechtsgrundlage

  • Einwilligung des Betroffenen: für die Verwaltung der über die Website angefragten Leistungen.
  • Berechtigtes Interesse des Verantwortlichen: soweit dies für zulässige kommerzielle Kommunikation oder die Verwaltung der Plattform erforderlich ist.

Herkunft und Kategorien der Daten

Die verarbeiteten personenbezogenen Daten stammen grundsätzlich vom Betroffenen selbst.

Verarbeitet werden insbesondere Identifikationsdaten, Post- und E-Mail-Adressen, kommerzielle Informationen sowie weitere Daten, die zur Bearbeitung einer Anfrage erforderlich sind.

Weitergabe an Dritte

Im Rahmen einer Anfrage können personenbezogene Daten – soweit erforderlich und vom Prozess vorgesehen – an kooperierende Stellen oder spezialisierte Partner weitergegeben werden, die diese Informationen eigenständig analysieren und Produkte oder Dienstleistungen anbieten können, die zum finanziellen Profil des Nutzers passen.

Nach der Übermittlung handeln diese Stellen als eigenständige Verantwortliche für die Datenverarbeitung. Für deren eigene Datenschutzpraktiken gelten die jeweiligen Datenschutzerklärungen der betreffenden Anbieter.

Internationale Datenübermittlungen sind nicht vorgesehen, außer wenn eine gesetzliche Pflicht besteht oder eine erforderliche Einwilligung vorliegt.

Kommerzielle Mitteilungen
